1. Conclusion of Contract

The rental agreement for the holiday apartment described below is concluded through booking via the landlord's website and subsequent booking confirmation by email. By placing a booking, the tenant accepts the landlord’s General Terms and Conditions as legally binding. The apartment is rented to the tenant for the specified duration exclusively for holiday purposes and may only be occupied by the maximum number of persons specified in the booking.

2. Rental Price and Additional Costs

The agreed rental price includes all flat-rate additional costs (e.g., electricity, heating, water). A deposit of 10% of the total price is due immediately upon booking. The remaining amount is due no later than 14 days before the rental begins, or – in the case of short-notice bookings – in cash upon arrival. Payments can be made by bank transfer, credit card, PayPal, or another payment method specified during the booking process. If the balance is not paid on time, the landlord is entitled to withdraw from the contract and rent the apartment to another party. Any payments already made will be refunded minus a processing fee of €50.

3. Security Deposit

No security deposit is required.

4. Arrival / Departure / Parking / Waste Disposal

Arrival: On the day of arrival, the apartment will be available to the tenant from 4:00 p.m. in a contractual condition.Check-in is automated, and tenants will receive all necessary information and access details in advance. Departure: On the day of departure, the tenant must vacate the apartment by 10:00 a.m. at the latest and leave it in a broom-clean condition. The following must be done by the tenant: Wash the dishes Empty the trash bins Dispose of glass waste Waste disposal: General waste, paper, and organic waste must be disposed of in the provided bins. Recyclables should be placed in the provided “Yellow Sack” and left tied up in the apartment upon departure. Bottle banks for glass waste are located near the apartments. More information can be found in the guest booklet available in the apartment. If waste separation is not observed, the landlord reserves the right to charge extra disposal costs. Parking: The holiday apartment "Zum blauen Schild" comes with a free parking space located at Untere Laube 2d (Parking space no. 129 in the 2nd basement level).

5. Cancellation by the Tenant

The tenant may cancel the rental agreement before the rental period begins by sending a written notice (e.g., via email) to the landlord. The date of receipt by the landlord is decisive. Cancellations up to 14 days before the start of the rental period are free of charge. After that, 100% of the rental price is due. Cancellation by email is sufficient and does not require confirmation by the landlord. The tenant has the right to prove that the landlord suffered no or significantly less damage. We strongly recommend taking out travel cancellation insurance.

6. Termination by the Landlord

The landlord may terminate the contract without notice before or after the start of the rental period if the tenant fails to make the agreed payments (deposit, balance) despite reminders or violates the contract to such a degree that continuing the rental is unreasonable. In this case, the landlord may claim reimbursement for any costs incurred and for lost rental income.

7. Cancellation Due to Extraordinary Circumstances

The rental agreement may be canceled by either party if fulfillment becomes significantly more difficult, dangerous, or impaired due to unforeseeable force majeure at the time of contract conclusion. In this case, both parties are released from their contractual obligations. Any services already rendered must be reimbursed.

8. Tenant’s Obligations

The tenant agrees to treat the apartment and its furnishings with care. The tenant is liable for any damage to furniture, rooms, the building, or facilities caused by them. Any damage must be reported to the landlord immediately. Minor damages (e.g., a broken glass or plate) do not need to be reported, but the tenant is expected to replace the item or document the damage before departure. In case of malfunctions or damage to facilities, the tenant is obligated to do what is reasonable to minimize the damage.

9. Liability of the Landlord

The landlord is responsible for the accuracy of the apartment description and for providing the agreed services properly. The landlord is not liable for property damage unless caused by intentional or grossly negligent conduct by the landlord or their agents.

10. Pets

Pets are allowed in the apartment only upon prior agreement with the landlord and are limited to one animal. The tenant is liable for any damage caused by their pet.

11. Contract Changes

Any side agreements, amendments, or additions to the contract, as well as all legally relevant declarations, must be made in writing. Communication by email satisfies the written form requirement.

12. House Rules

Guests are expected to be considerate of one another. In particular, loud noises (e.g., slamming doors) should be avoided. Quiet hours: Night: 10:00 p.m. – 8:00 a.m. Midday: 12:00 p.m. – 2:00 p.m. Playing musical instruments or any loud activities disturbing others are prohibited during these hours. Audio and video devices must be kept at room volume. Repeated or significant violations of the house rules may lead to immediate termination of the rental agreement.

13. Governing Law and Jurisdiction

German law applies. The place of jurisdiction for all disputes arising from this agreement is the District Court of Konstanz.
